Welcome to AnyAustin (the “Service”), a website operated by Azul Bricks LLC (“we,” “us,” or “our”). By accessing or using the Service — including by subscribing to “Your Austin Playlist” — you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Service.
1. Who we are
AnyAustin is operated by Azul Bricks LLC, a Texas limited liability company. These Terms form a binding agreement between you and Azul Bricks LLC.
2. The Service
AnyAustin publishes free, locally-curated listings of things to do in and around Austin, Texas. The core site is free to use. “Your Austin Playlist” is an optional paid subscription that delivers a curated weekly message of selected events. Event information is provided for convenience and may change; we don’t own, host, or guarantee third-party events, venues, dates, prices, or availability, and you should confirm details with the organizer.
3. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to create a subscription. By subscribing you represent that the information you provide is accurate and that you are authorized to use the payment method you supply.
4. Subscriptions, billing & trials
- “Your Austin Playlist” is billed on a recurring basis at the price shown at sign-up, which renews automatically each billing period until cancelled.
- If a free trial is offered, we collect your payment details at sign-up but charge nothing until the trial ends. If you cancel before the trial ends, you are not charged.
- Payments are processed by Stripe. We do not collect or store your full card details. Your use of Stripe’s checkout is subject to Stripe’s own terms.
- Prices may change; we’ll give notice of any change before it applies to your next billing period.
5. Cancellation & refunds
You may cancel anytime using the manage/unsubscribe link included with every message; cancellation stops future renewals and takes effect at the end of the current billing period. Except where required by law, payments already made are non-refundable, and we do not provide partial-period refunds. The free site remains available to you whether or not you subscribe.
6. Acceptable use
You agree not to misuse the Service, including: scraping or bulk-extracting content except as permitted; interfering with or disrupting the Service; attempting to gain unauthorized access; reselling or redistributing the paid content without permission; or using the Service to violate any law or the rights of others.
7. Intellectual property
The Service, including its original text, design, curation, and branding, is owned by Azul Bricks LLC and protected by applicable laws. We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal, non-commercial use. Event details supplied by third parties remain the property of their respective owners.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that event listings are accurate, complete, or current, or that the Service will be uninterrupted or error-free.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AZUL BRICKS LLC AND ITS MEMBERS, MANAGERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR FROM ATTENDING ANY EVENT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $50.
10. Indemnification
You agree to indemnify and hold harmless Azul Bricks LLC from any claims, damages, or expenses (including reasonable attorneys’ fees) arising out of your misuse of the Service or your violation of these Terms.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the “Effective” date above and, where appropriate, by additional notice. Your continued use of the Service after changes take effect constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any dispute will be the state or federal courts located in Travis County, Texas, and you consent to their jurisdiction.
